When Wadi AL-Niel café in Tahrer Square was exploded in Egypt in 1993, The Islamic Jamaa in Egypt issued a declaration signed by Karam Zuhdi , Sheikh Aboud Al_Zoumor and Sheikh Nageh Ibrahim which called the your Muslims to be a way from involving in such disgraceful acts because those acts are accompanied with many illegal mistakes. Those acts were repeated in the same way in Riyadh, Casablanca, Turkey and Indonesia . It was necessary to explain that case. We do not want to take about the explosion at the time of war which is agreed upon according to the Islamic regulation. We will talk about these explosions which are practiced randomly and involve a lot of innocent people.
First, we will talk about the aim of those who practice these actions.
1- Killing some people who are wanted to be killed even though that leads to the killing of others.
2- Killing the majority of people who are found in that place to cause panic and terror.
3- Damaging and destroying the property and the building even though there are some people who are not involved.
It is clear that some people would die in those action despite the illegality of killing them. There might be Muslims or people of the Book among the victims or there might be tourists or foreigners who came to our countries expecting to be safety.
The legal proofs from the Islamic Jurisprudence which forbids these acts:-
1 - There are Muslim among those who are killed in these acts who did nothing to be killed. Practicing these exposing with the Knowledge of involving innocent Muslims is considered Killing them deliberately and it is banned " And whoever kills a believer intentionally his punishment is Hell, he shall abide in it forever ……"(Surah 4 - 93)
And the prophet (PBUH) said "The Muslim should not kill a Muslim except for three reasons to be a killer to commit adultery even he or she is married or the person who goes astray from his religion"(Mostafak Alieh )
After these proofs, how can we kill Muslims who did nothing but existed in the place of the explosion?
2- We can not kill the people of Dhimma (non –Muslim living under the protection of an Islamic government). The prophet (PBUH) said "Who ever kills a Dhimmi or a Heathen between them and him a convention, he will not smell the paradise although It can be smelt before It can reached by forty years"(Narrated by Bukhari)
3- It is illegal to kill those who came to enjoy safety in our countries " And if any of the unbelievers seeks from you protection, grant him protection …"(surah 9 - 6) The prophet ( PBUH ) said " The convention of Muslim is a whole is respected by all who ever kill a Muslim is disgraced by Allah the Al might, his angels and all people and also his acts and deeds are not accepted "
4 - We cannot mean non Muslim children, women and old aged by killing as long as they do not attack us. These people are not to be killed at the time of war as the prophet (PBUH) ordained us. How could we see killing them at the time of no war?
5 - These explosions result in damaging some of the property of other who do not commit any thing to be punished like that .The prophet ( PBUH ) said " Your blood is forbidden amongst you as well as your money ……"(Narrated by Muslim )
Those who see these explosions accepted in the Islamic countries:-
1- The real proof:-They see it see it accepted to have some innocent victims amongst Muslims as their blood is protected as they went astray from Islam.
2- The legal proof of Shariaa:-
They believe that the prophet (PBUH) attacked non -Muslims at night. When he was asked about their women He (PBUH) said "They are the same." Some people say that it is accepted to attack them without alarming.
3- Contemplating the Islamic use of "Manganiq" [Which is a weapon like "Mortar" in modern wars] to attack and surround cities. They believe that the "Manganiq" was a whole destructive weapon and the prophet (PBUH) used it, so it is accepted to use the explosives in the same way .
4- They believe that some scholars agreed upon killing the Muslim who is used as a human amour. They see that it is a accepted to kill the person who deserves to be killed even if killing him leads to killing other innocent people like his guards or those who came to be at the place of exposition at the same time.
Explaining the mistake of the realistic proof
1- Alleging all Muslims went astray from the straight religion's path is not a proper idea which cannot prove and unreal .Most Muslims practice their duties and avoid the things which get them out of the religion of Islam. In each Islamic country there is an Islamic Movement which apply the Quran and the Sunnah .
2- Considering Muslim away from Islam because of committing sins and making mistakes is not correct. The people who follow the Sunnah believe that committing mistakes dose not get Muslims out of their religion Sins contrast with Faith but do not demolish it " … And Adam disobeyed his lord and went astray " (surah 20 - 121)
3- It is incorrect to depend on the existence of some Muslims who commit sins which are considered kinds of calling Gods with Allah the Al might one like supplicating and sacrificing animals for the sake of Allah the Al mighty. These people did so because of ignorance which prevents us from calling them Heathens.
4- We cannot call a whole nation Heathens depending on the committing of sins by some individuals like making friendships with non - Muslims loving non – Muslims dose not put you in the path of kufr (Disbelieving in Allah). This friendships is accepted unlike the friendships and liking which Ibn Abi Baltaah did at the time of a war between the prophet ( PBUH) against the Heathen as he told them about the time of the attack of Muslim against them ; so we cannot find a legal proof in Shariaa to describe those people as Heathen .
Discussing the proofs they have to make the explosions legal:
1- Those whom the prophet (PBUH) attacked were disbelieves like Bani Al- Mostalaq and their places were distinguished form others so how can use it a proof to practice killing acts in Islamic countries.
2- The majority of the great Muslim scholars believed that attacking the Heathens suddenly is accepted even though it ld to killing woman and children but not deliberately. Emam Ahmed and Emam Shafai believed so .How can we accept these explosions though their committer know that there are Muslims amongst the victims.
3- When the Muslims are found with non Muslims, it is unaccepted to practice the killing acts when we are sure that there are Muslims who might be injured or killed."… And if it had not been for believing men and believing women whom you did not know , whom you might have fought and so incur upon yourselves unknowingly a sin , that Allah may admit into His Mercy who ever He pleases …. " (Surah 48 - 25)
Qortobi said " this verse is a proof of taking care of Muslim as long as they are with Muslims " Ibn Al-qasem was asked about a place where Muslims are captured inside it and the Muslims surrounded it and wanted to attack that place .He answered that Malik was asked a question like that and he replied that he did not approve the idea "….Had the believers been separated a way from the disbelievers we should surely have chastised the disbelievers among them with a severe chastisement " (Surah 49 - 25)
After that explanation, is it accepted to attack Muslims suddenly? Is it accepted to kill non Muslims children , women and old aged deliberately that there are Muslims at the place of the explosions ?The answer is surely no . It is illegal to kill them. These are who accept it because of the wrong understanding and application of the judgments of attacking enemies on the real ground.
